Olivier Martinez was photographed smoking outside the courthouse on Monday, October 19, 2026, as his contentious custody battle with ex-wife Halle Berry continued, according to TMZ.com. The image, obtained by TMZ, shows Martinez wearing sunglasses and smoking during a break in proceedings.
The custody dispute centers on the former couple's 13-year-old son, Maceo. On Monday, Maceo provided sealed testimony in the case. The judge ordered both Berry and Martinez to leave the room while the teenager testified, according to TMZ.com.
Berry appeared in good spirits entering and leaving the courthouse, smiling and holding hands with her boyfriend, Van Hunt, TMZ.com reported. Martinez's demeanor outside court contrasted with that of his ex-wife, the outlet noted.
The legal proceedings follow allegations by Martinez that Berry attacked and choked their son during an argument over a virtual reality game the boy had been playing. A judge previously granted Martinez a temporary restraining order against Berry, which restricted the amount of contact she may have with Maceo.
Martinez is seeking sole custody of Maceo, while Berry is asking the court to restore the previous custody arrangement. Berry has denied the accusations against her.
The case remains under judicial review, with the sealed testimony from Maceo now part of the court record. No further rulings have been announced.
