The contentious divorce between former NFL player Kroy Biermann and reality television personality Kim Zolciak has taken another dramatic turn, with Biermann filing new court documents seeking permanent physical and legal custody of their four minor children.

According to court documents obtained by TMZ, Biermann is requesting that the presiding judge grant him full custody, alleging that Zolciak, known for her appearances on "The Real Housewives of Atlanta," has been neglecting their children and acting in ways harmful to their best interests.

The filing represents a significant escalation in the ongoing custody dispute between the estranged couple. Under the current custody arrangement, two children reside with Zolciak while two stay with Biermann, with the parents periodically swapping to spend time with the other two children. Biermann criticized this arrangement in his court filing, stating, "The children were rarely together as a group under this parenting plan."

In his legal motion, Biermann claimed that Zolciak "acts in ways that are harmful to the children and contrary to their best interests." He further argued that all four children should reside under one roof and asserted that he possesses evidence demonstrating Zolciak is "both unstable and unfit" as a parent.

The court documents also reference recent developments in the case. Earlier this month, Zolciak had her custody temporarily suspended pending the completion of court-ordered therapy sessions. According to Biermann's filing, Zolciak completed the required four sessions over a seven-day period.

Biermann's allegations extended beyond general fitness concerns. In his filing, he claimed that Zolciak "is more selfishly concerned with her own image and her work options than with the opinions of experts and/or the best interest of the children." He characterized this behavior as constituting "neglect of the minor children" and argued it is "harmful to the progress and healing of the family unit."

Zolciak's legal team responded swiftly and forcefully to the allegations. Her attorney provided a statement denying the claims and criticizing the decision to file the motion. "[Kroy's] decision to file this motion lacks factual support and is unwarranted," the lawyer stated. "We will address these claims in the proper legal forum and will vigorously defend the truth in court, rather than through public discourse."

The custody battle represents the latest chapter in what has become a protracted and highly publicized divorce proceeding between the former couple. As the case continues to unfold in the court system, both parties appear prepared for an extended legal fight over the welfare and custody of their children.

The matter will now proceed through the appropriate legal channels, where a judge will evaluate the evidence and arguments presented by both sides before rendering a decision on the custody arrangement.
